The Value of Mediation in a Personal Dispute

Personal disputes, whether with friends or relatives can be particularly difficult to live with because of how close emotionally we have often been to the other person. Instinctively and often unconsciously, each can push the other’s psychological buttons.

Mediation uses an objective independent mediator present who:

  • Has no interest nor involvement in the dispute;

  • Will absolutely maintain the confidentiality of what is said and done in the mediation (subject to the required disclosure to authorities of serious crimes);

  • Sets and maintains ground rules about respectful communication;

  • Does not attribute blame;

  • Encourages you to let each other know how you are feeling and why; and

  • Assists you to work together to find and agree on solutions which you each can live with that will help you preserve your relationship.

As with any mediation, it will only work if the individuals approach it on a voluntary basis, with goodwill to seek a resolution of the issues which have caused and contribute to the ongoing dispute between them.The process usually involves initial, separate and confidential meetings between the mediator and each person involved (these Intake Interviews are usually of 1 hour duration), after which the mediator will determine whether the dispute is suitable for mediation and, if so, the format it should take.

 

Because these mediations may be emotionally intense, we recommend that the parties usually restrict the mediation time to 3 hours, with an additional session on a subsequent day if more time is required.

Overall, mediation provides a more collaborative, solution-focused approach to resolving family disputes, which can help to reduce conflict, preserve relationships, and promote understanding between family members.

We charge $350 an hour (plus GST) for each Intake Interview on the basis of an initial charge of 1 hour plus any additional time in 15 minute increments.

We then charge a flat rate of $1,500 (plus GST) for the first mediation session of up to 3 hours (which includes preparation time) with additional sessions charged at the rate of $350 an hour (plus GST).  If it is necessary to hire rooms, these are charged at cost.

The total cost of the mediation is usually split evenly between the parties, unless they wish to agree to some other apportionment.
